"The Law Is Ready. The Hearts Must Follow."

Why Every Legal Avenue Has Hit a Dead End — and the One Truth Nobody Has Named Yet

A woman I will call Sister Who Paints woke up one morning hearing two words she had never spoken aloud.
Wakan Tanka.
She did not know what they meant. She went to her canvas anyway and began painting the Black Hills before she had even checked her email. When the painting was finished, two more words rose from it:
Warranty Deeds.
She went to the internet. She found the 1868 Fort Laramie Treaty. She found the 1980 Supreme Court ruling ordering the United States government to pay $105 million dollars in compensation for the illegal seizure of the Black Hills — a payment our people have refused for over forty years, because the Black Hills are not for sale.
And then she found a property law maxim so fundamental it barely needs stating:
A seller of land can only transfer title to the extent he possesses it.

She wrote to me electrified, ready to fight. She proposed lawsuits, international courts, legal strategies built on this maxim. She offered everything she had.
And I had to tell her the truth she wasn't expecting.

The Legal Work Is Already Done

"Reclaiming the Black Hills" — a document overseen by our international lawyer and publicly available for over twenty years — contains every legal argument, every international law reference, every avenue Sister Who Paints discovered and considerably more. Independent legal firms have taken this work upon themselves countless times, searching for a way through what they considered were the existing blockades.

Yet, all along, the legal foundation is solid. Thoroughly documented. Constitutionally and internationally supported.
And yet here we are.

The Black Hills have not come home. The $105 million sits unclaimed. The treaty violations are acknowledged by the courts that refuse to remedy them. Decades of brilliant legal work still not fully heard by international courts, still have produced exactly nothing in the way of restoration.
Do you know why?

Here is the truth that has not been spoken plainly in any courtroom, any legal brief, any treaty negotiation, any Native advocacy meeting:

The legal avenue itself is colonized thinking.

Not the lawyers. Not their intentions. Not the documented injustice — that is real and irrefutable and must continue to be documented. But the foundational belief — that a court system built by colonization, sustained by colonization, and operating entirely within the fear-based architecture of colonization can ultimately deliver genuine justice to the people that same system was designed to permanently dispossess — that belief is the trap inside the trap.

You cannot get free using the master's tools when the master built those tools specifically to prevent your freedom.

This is not cynicism. This is observation. Forty years of observation, case by case, generation by generation, brilliant legal mind after brilliant legal mind arriving at the same wall.

Fear Cannot Create Life

My late husband said something I have carried ever since, turning it over in my hands the way you turn a stone medicine:
What they practiced on the Lakota has now been perfected on the whole world.

The strategy of colonization was never primarily about land. Land was the material target. But the mechanism — the actual technology deployed — was separation.

Separation from land. From language. From ceremony. From ancestors. From the sacred reciprocal relationship with the living world that made people whole, sovereign, and genuinely free in a way no legal document can manufacture.

And that mechanism runs on one fuel only: fear.

Fear of scarcity. Fear of the other. Fear of loss. Fear of being wrong, being less than, being left behind. Fear dressed as practicality, as realism, as legal strategy, as political necessity.

Here is what our ancestors understood that the colonized world has almost entirely forgotten:
Fear cannot create life. It can only diminish and destroy it.

Fear is not real in the way love is real. Fear is a story the ego tells to survive its own sense of separation. And the ego — that small protective suit we stitch together from trauma, conditioning, and insecurity — needs exactly three things to sustain itself:
Hierarchy. Conflict. Recognition.

It needs to win. To be right. To be defended. To be special. To be more deserving than, more important than, more advanced than.

Watch any treaty negotiation through this lens and you will see it immediately. Watch any legal brief. Watch any protest movement. Watch any organization claiming to speak for a people — Native or otherwise — and count how many decisions are made from genuine collective wisdom versus how many are made from ego's desperate need to be the one who wins, who leads, who gets the credit.

This is the wound beneath the wound beneath the wound.

And no court system — itself built entirely on hierarchy, conflict, and the recognition of whoever holds the most power — can heal a wound it was designed to inflict.

The Invisible Platform

I want to pause here and say something that may surprise you.

The ego cannot shop there. There is nothing on offer that feeds it.

The ego goes to the wellness boutique and buys the white sage bundle because THAT feeds it. It gets to feel spiritually evolved. It gets to signal its elevation. It gets hierarchy and recognition wrapped in a paper bow.

IndigenousHealing.io offers liberation. 
And the ego — that ripple on the ocean that has convinced itself it IS the entire Pacific — experiences liberation as annihilation.

Of course it looks away.

This is not a new problem. Every genuine wisdom tradition in human history has faced it. The teachers who drew the largest crowds were always the ones who gave the ego something to hold — a title, a ranking, a secret knowledge, an in-group identity that made the seeker feel chosen.

The teachers who offered only truth drew the few who were genuinely ready to receive it.

The Resonance Walkers who find IndigenousHealing.io and stay are not the majority. They are the ones Crazy Horse's prophecy pointed toward — the people of all colors who have grown tired enough of the ego's noise to listen for something underneath it.

They are enough. They have always been enough.

The Property Maxim and the Real Claim

I want to return to Sister Who Paints and her discovery — because it matters.

The maxim she found is true. A seller cannot transfer title to land they do not legitimately possess. The chain of titles flowing from the illegal seizure of the Black Hills is legally encumbered at its root. The 1980 Supreme Court acknowledged the theft. The $105 million exists as a monument to that acknowledgment.

This legal reality must continue to be documented, publicized, and pressed forward. It is not irrelevant.

But it is the last step of the healing, not the first.

Until colonized court systems become truthful — until they find the genuine will to uphold the very laws they espouse — no legal action alone can complete the restoration. And that will cannot be legislated. It cannot be argued into existence.

It can only emerge from the interior transformation of enough human beings that the outer structures are forced to reflect what the inner landscape has already become.

We are living dirt. Walking land.

When the walking land comes into alignment with how living soil must most effectively walk — in balance, in harmony, in abundance, in peace — then land back occurs. Not through force. Through the irresistible gravity of a people who have remembered what they are.

That is the truth underneath every legal document, every treaty violation, every court acknowledgment that has changed nothing: the law was never going to be what heals this.
